Fails to comply with any order or direction lawfully given to him or nay requisition lawfully made upon him under any of the said provisions, shall be an offence punishable- (a) In the case of the first offence with fine which may extend to the amount specified in that behalf in the third column of the said Schedule or with simple imprisonment for a term which may extend to one month or with both and in the case of second or subsequent offence with fine which shall not be less than one thousand rupees or with simple imprisonment for a term which shall not be less than one month but which may extend to two months or with both; (b) In the case of a continuing contravention or failure, with daily fine which may extend to the amount specified in the fourth column of that Schedule for everyday during which such contravention or failure continues after conviction.
